§1. Seller Information

§2. Definitions
- Terms and Conditions – these Store Terms and Conditions, setting out the rules for concluding and performing distance Sales contracts, the rights and obligations of the Customer and the Seller, as well as the complaint procedure; with respect to services provided by electronic means, they constitute the terms of service referred to in art. 8 of the Polish Act on Providing Services by Electronic Means.
- Seller – Home Screen Magdalena Cylke, based in Koszalin, Tax ID (NIP): 4990574327, REGON: 520836138.
- Store – the online store operated by the Seller at homescreen.pl.
- Customer – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality to which the law grants legal capacity, concluding a contract with the Seller.
- Consumer – a natural person performing a legal act with the Seller not directly related to their business or professional activity.
- Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, where the content of the contract indicates that it is not of a professional nature for that person, resulting in particular from the subject of the business activity they perform as disclosed in CEIDG; the provisions of the Terms and Conditions concerning the Consumer apply to them accordingly.
- Entrepreneur – a natural person, legal entity, or organizational unit conducting business or professional activity in their own name, concluding a contract in direct connection with that activity of a professional nature (business purchase).
- Goods – a movable item offered in the Store.
- Sales contract – a contract for the sale of Goods concluded between the Seller and the Customer via the Store.
- Order – the Customer's declaration of intent aimed directly at concluding a Sales contract, specifying in particular the type and quantity of Goods and the remaining conditions.
- Cart – a Store functionality enabling the compilation of an Order.
- Account – a set of the Customer's data in the Store enabling the placing of Orders and access to Order history.
- Business days – days from Monday to Friday, excluding public holidays in Poland.
- Durable medium – a material or tool enabling the storage of information in a manner allowing future access to it and its reproduction in unchanged form, in particular electronic mail.
- Sales document – a fiscal receipt or an invoice, including in electronic form (e-receipt or e-invoice), delivered, among others, to the Customer's email address.
§3. General Provisions
Through the Store, the Seller provides services by electronic means consisting in particular of: enabling the browsing of Goods, maintaining an Account, placing Orders and concluding distance Sales contracts, adding reviews, and sending emails related to Order fulfillment.
To use the Store, the following are required: a device with Internet access, an up-to-date web browser (e.g. Chrome, Firefox, Safari, Microsoft Edge), an active email account, and software enabling the reading of PDF files.
Information about Goods provided in the Store, in particular their descriptions and prices, does not constitute an offer within the meaning of the Polish Civil Code, but an invitation to conclude a contract within the meaning of art. 71 of the Polish Civil Code.
Prices in the Store are gross prices (including VAT) and are expressed in Polish zlotys or in another currency indicated in the Store. Prices do not include delivery costs, which are provided separately when placing an Order.
The Seller makes the Terms and Conditions available free of charge before the conclusion of the Sales contract, and at the Customer's request – in a manner enabling their acquisition, reproduction, and recording (printout or saving to a medium).
The Seller applies technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular preventing the acquisition and modification of personal data by unauthorized persons.
The Customer is prohibited from providing content of an unlawful nature and from using the Store in a manner that disrupts its functioning.
§4. Account and Registration
The Customer may place an Order after creating an Account or without registration (as a guest). In the case of a purchase without registration, an internal technical account is created to enable the fulfillment and handling of the Order.
Creating an Account is voluntary and free of charge. To register, the Customer fills out a form, providing the required data and accepting the Terms and Conditions.
The Customer is obliged to provide truthful and up-to-date data. Providing false data constitutes a violation of the Terms and Conditions.
The Customer is obliged to keep their login credentials confidential and not to share them with third parties.
The Customer may delete the Account at any time by contacting the Seller. Deletion of the Account does not affect the validity of previously concluded Sales contracts.
§5. Placing Orders
Orders can be placed 24 hours a day, 7 days a week, via the Store.
To place an Order, the Customer: selects the Goods and adds them to the Cart, fills out the electronic order form (delivery and billing data), chooses the delivery and payment method, accepts the Terms and Conditions, and then confirms the Order with the „Order and pay” button.
Before submitting the Order, the Customer is shown a summary containing: the Seller's data, the subject of the Order, the unit and total price of the Goods, the costs and method of delivery, the selected payment method, and the processing time.
Clicking the „Order and pay” button constitutes the Customer's binding declaration of intent to conclude a Sales contract and entails an obligation to pay.
The Sales contract is deemed concluded upon the Seller's confirmation of acceptance of the Order. Immediately after placing the Order, the Customer receives, at the provided email address, a confirmation of its acceptance, containing the essential elements of the Order and the information required by law, including instructions on the right of withdrawal from the contract (Annex 1).
Until the processing of the Order begins, the Customer may change or cancel it by contacting the Seller. In the event of cancellation of a paid Order, the Seller refunds the payment received.
The Seller may refuse to process an Order if false data is provided or if it is impossible to contact the Customer.
The Order processing time is indicated for each item of Goods in the Cart. In the case of an Order comprising Goods with different processing times, the entire order is shipped after all Goods have been collected (the longest processing time applies).
§6. Prices and Payments
Prices of Goods are gross prices and do not include delivery costs, which are provided separately when placing an Order.
In accordance with the information obligation (the so-called Omnibus Directive), in each case of a price reduction of the Goods, the Seller provides, alongside the reduced price, also the lowest price of those Goods in effect during the 30 days preceding the introduction of the reduction.
Available payment methods:
- electronic payment (payment card, BLIK, fast transfer) processed via the payment operator Stripe;
- cash on delivery (upon receipt) – if available for the selected delivery method;
- traditional bank transfer – in cases individually agreed with the Seller.
The electronic payment operator is Stripe Payments Europe, Ltd. Transactions are settled in accordance with the operator's terms; the Seller does not store the Customer's payment card data.
The Customer is obliged to make payment within 3 days of placing the Order (does not apply to cash on delivery). Failure to pay within this period may result in cancellation of the Order.
Order processing begins after the payment is credited, and for cash on delivery – after confirmation of the Order.
For each Order, the Seller issues a Sales document (receipt or invoice), delivered in electronic form or together with the Goods.
§7. Delivery
Delivery is carried out within Poland and to other countries indicated in the Store.
The available delivery methods (including courier, parcel locker, pickup point) and their costs are presented when placing an Order and depend on the selected method and country of delivery.
For orders over 100 PLN, delivery within Poland is free, unless the Store indicates otherwise.
The Order processing time is provided for each item of Goods and is counted in Business days from the day the Sales contract is concluded, and in the case of prepayment – from the crediting of the payment.
If the ordered Goods are unavailable, the Seller will promptly inform the Customer and refund the payment received for the unavailable Goods.
It is recommended to check the shipment upon receipt. If damage is found, the Customer may prepare a damage report with the carrier, which may facilitate the pursuit of claims; this is not, however, a condition for considering a complaint.
If the Customer does not collect the Goods, as a result of which they are returned to the Seller, the Seller may withdraw from the Sales contract after first calling on the Customer by email to perform the contract. In such a case, the Seller refunds the payment received for the Goods.
§8. Right of Withdrawal
A Consumer, as well as an Entrepreneur with consumer rights, who has concluded a distance Sales contract may withdraw from it within 30 days without giving a reason and without incurring costs, except for the costs indicated below.
The withdrawal period begins when the Consumer or a third party indicated by them, other than the carrier, takes possession of the Goods, and in the case of a contract comprising multiple Goods delivered separately, in batches, or in parts – from taking possession of the last item of Goods, batch, or part. To meet the deadline, it is sufficient to send the statement before its expiry.
The Consumer may withdraw from the contract:
- by submitting a statement by email to info@homescreen.pl or in writing to the Seller's address;
- by using the electronic return form available in the Store;
- by using the model withdrawal form constituting Annex 1 to the Terms and Conditions (use of the model is not mandatory).
The Seller will promptly confirm to the Consumer receipt of the withdrawal statement on a Durable medium (e.g. by email). In the event of withdrawal, the contract is considered not concluded.
The Seller, no later than within 14 days of receiving the withdrawal statement, refunds to the Consumer all payments made by them, including delivery costs (except for additional costs resulting from a delivery method chosen by the Consumer other than the cheapest ordinary method offered by the Seller). The refund is made using the same payment method used by the Consumer, unless they have expressly agreed to another solution.
The Seller may withhold the refund until the Goods are received back or until the Consumer provides proof of their return, whichever occurs first.
The Consumer is obliged to return the Goods to the Seller promptly, no later than within 14 days of withdrawal. To meet the deadline, it is sufficient to send back the Goods before its expiry. The Consumer bears the direct costs of returning the Goods.
The Consumer is liable for any diminished value of the Goods resulting from using them in a manner going beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.
The right of withdrawal does not apply, among others, to the contracts indicated in art. 38 of the Polish Consumer Rights Act, in particular contracts:
- for the provision of services, if the Seller has fully performed the service with the express prior consent of the Consumer who was informed of the loss of the right of withdrawal;
- in which the subject of the performance is non-prefabricated Goods, manufactured according to the Consumer's specifications or serving to meet their individualized needs;
- in which the subject of the performance is Goods delivered in sealed packaging which, after opening, cannot be returned for health protection or hygiene reasons, if the packaging was opened after delivery;
- in which the subject of the performance is Goods which, after delivery, due to their nature, become inseparably combined with other items;
- in which the subject of the performance is Goods that are perishable or have a short shelf life.
Detailed instructions on the right of withdrawal from the contract are set out in Annex 1 to the Terms and Conditions.
§9. Complaints (lack of conformity of the Goods with the contract)
The Seller is obliged to deliver Goods that conform to the Sales contract. Towards a Consumer and an Entrepreneur with consumer rights, the Seller is liable for the lack of conformity of the Goods with the contract under the rules set out in chapter 5a of the Polish Consumer Rights Act.
The Seller is liable for any lack of conformity of the Goods with the contract existing at the time of their delivery and revealed within 2 years from that moment.
A complaint may be submitted:
- via the electronic complaint form available in the Store;
- by email to info@homescreen.pl or in writing to the Seller's address.
It is advisable to provide in the report the Customer's data, information concerning the Order, a description of the non-conformity, and the Customer's request. This data facilitates the consideration of the complaint, but its absence does not affect the complaint's effectiveness.
In the event of a lack of conformity of the Goods with the contract, the Consumer may demand repair or replacement of the Goods. If repair or replacement is impossible or would require excessive costs, or if the Seller fails to carry them out within a reasonable time or without excessive inconvenience to the Consumer, the Consumer may demand a price reduction or withdraw from the contract (where the lack of conformity is significant).
The Seller considers the complaint and provides a response within 14 days of its receipt. Failure to respond within this period means acceptance of the complaint. The Seller provides the response to the Customer in writing or on a Durable medium.
The costs of repair or replacement, including shipping costs related to the complaint, are borne by the Seller. The Consumer makes the Goods subject to repair or replacement available to the Seller; the Seller collects the Goods at its own expense.
With respect to Customers who are neither Consumers nor Entrepreneurs with consumer rights (business sales), the Seller's liability under the statutory warranty for defects is excluded to the extent permitted by law.
§10. Reviews
A Customer who has made a purchase may voluntarily and free of charge submit a review or rating (in the form of stars) concerning the Goods or the handling of the Order.
The Seller does not currently use tools allowing verification of whether reviews come exclusively from persons who purchased the given Goods. Accordingly, reviews published in the Store are not marked as verified for purchase and are for informational purposes only.
By submitting a review, the Customer declares that its content is true and does not infringe the rights of third parties.
It is not permitted to post content that is unlawful, false, misleading, vulgar, offensive, infringing the rights of third parties, or of an advertising nature. The Seller is entitled to remove such content.
By posting a review constituting a work within the meaning of copyright law, the Customer grants the Seller a non-exclusive, free, and territorially unlimited license to use it within the scope of public sharing in the Store.
§11. Intellectual Property
The content made available in the Store, in particular the name, logo, descriptions, photographs, graphics, and page layout, is subject to legal protection and belongs to the Seller or to entities with which the Seller has concluded relevant agreements.
It is prohibited to copy, reproduce, distribute, or otherwise use this content without the consent of the rights holder, beyond the permitted use resulting from the law.
The Customer is not entitled to interfere with the content, structure, form, or operating mechanism of the Store.
§12. Out-of-Court Dispute Resolution
The Consumer has the option to use out-of-court methods of handling complaints and pursuing claims.
The Consumer may contact:
- The Provincial Inspector of Trade Inspection with a request to initiate mediation proceedings
- A permanent consumer arbitration court at the provincial inspector of Trade Inspection
- The Office of Competition and Consumer Protection (UOKiK)
For cross-border disputes, the Consumer may seek assistance from the European Consumer Centre (ECC), which operates in Poland at UOKiK (konsument.gov.pl). Detailed information on out-of-court dispute resolution is available on the UOKiK website: www.uokik.gov.pl.
All disputes will be resolved by Polish courts with jurisdiction in accordance with the Code of Civil Procedure.
§13. Personal Data
The Seller is the administrator of personal data.
Personal data is processed for the purpose of order fulfillment, complaint handling, and, with the Customer's consent, for marketing purposes.

§14. Newsletter
The Customer may consent to receiving a newsletter containing information about news and promotions.
Subscribing to the newsletter is voluntary and free.
The Customer may unsubscribe from the newsletter at any time by clicking the unsubscribe link in the email or by contacting the Seller.
§15. Price and Terms Changes
The Seller reserves the right to change product prices and delivery costs. Changes do not apply to orders already placed.
The Seller reserves the right to change the Terms and Conditions. Changes take effect 14 days after publication on the Store's website.
For orders placed before the changes take effect, the Terms and Conditions in force at the time of placing the order apply.
§16. Final Provisions
The Terms and Conditions apply from the day of their publication in the Store.
In matters not regulated by the Terms and Conditions, the provisions of Polish law apply, in particular the Polish Civil Code and the Act of May 30, 2014 on Consumer Rights.
The Seller reserves the right to amend the Terms and Conditions for important reasons, in particular changes in the law, payment and delivery methods, or the functionality of the Store. For Orders placed before the changes take effect, the Terms and Conditions in force at the time of placing the Order apply. Customers who have an Account are informed of changes by email.
If any provision of the Terms and Conditions is found to be invalid or ineffective, the remaining provisions remain in force.
The applicable law is Polish law. The choice of Polish law does not deprive the Consumer of the protection afforded to them by provisions that cannot be excluded by contract, in force in the country of their habitual residence.
The content of the Terms and Conditions is available in the Store and may be preserved by printing or saving to a medium.
